Xsolla Advertising Guidelines

The following (“Guidelines”) issued by Xsolla (USA), Inc. (“Xsolla”) are supplementary to Xsolla’s reserved “Quality Control Rights” under Section 7 of the Master Agreement for Advertising Campaigns available at: Master Agreement for Advertising Campaigns (“Agreement”). These Guidelines are intended to be merely illustrative (and are not exhaustive) and do not bind Xsolla to contract with any particular Advertiser (as defined in the Agreement), nor bind Xsolla to display any particular Ad(s) (as defined in the Agreement).

GENERAL PRINCIPLES

In all instances, Advertiser’s Ads should be honest, safe, and respectful. The Ads should provide informative value to end-users without being misleading or harmful.

All Ads must:

  • Be clearly identifiable as advertising and not be indistinguishable from the digital properties upon which the advertising is served
  • Comply with all applicable laws and regulations
  • Be appropriate for the intended audience and not be intentionally targeted to children

1.0 ACCURACY AND TRANSPARENCY

1.1 Claims and Offers

  • All Ad claims must be factually supportable
  • Discounts and/or any price offers must be current and include explicit instructions for the end-user to redeem the same discounts and/or price offers
  • Reward items tied to end-user behavior (e.g., “Receive 20 virtual coins after downloading this app!”) must clearly and conspicuously inform the end-user how to convert the end-user’s behavior into receiving the reward item.
  • Advertised products and prices must be available within two clicks of Advertiser’s landing page
  • When using the term "free," disclose all material terms and conditions to the end-user to obtain the free item

1.2 Special Categories

  • Food Products: Comply with all applicable laws regarding ingredients and quality control certifications
  • Weight Loss: No unrealistic claims, no intentional targeting of children, include clear disclosures
  • Promotions/Contests: Disclose that no purchase is necessary, do not imply every entry results in a win

2.0 USER EXPERIENCE AND SAFETY

2.1 Non-Disruptive Experience

  • No pop-up Ads that cover or overlay content
  • No auto-expansion of the Ad size without user initiation
  • No auto-play video with audio
  • No forced countdowns to dismiss Ads
  • No flashing animations
  • Ads should not exceed thirty percent (30%) of page density

2.2 End-User Cyber Safety

  • No phishing or attempts to obtain personal information through deception
  • No malware, spyware, or harmful code
  • Ad must connect the end-user to the described offering in the Ad.
  • Xsolla reserves the right to reject any Ad that excessively redirects the end-user.
  • No selling of free items or official services available elsewhere for free

3.0 PROHIBITED CONTENT

3.1 Deceptive or Misleading Content

  • No false or deceptive claims about products or services
  • No simulating functionality that doesn't exist (e.g., fake buttons, dialogue boxes, etc.)
  • No "bait and switch" tactics intended to mislead consumers
  • No misleading users about landing page content

3.2 Harmful or Offensive Content

  • No content that promotes violence, discrimination, or hate speech
  • No content showing children in dangerous or compromising situations
  • No violence, gore, or graphic imagery
  • No content that exploits sensitive events like natural disasters or other mass casualty events
  • No profanity, obscene language, or otherwise vulgar content

3.3 Illegal Products and Activities

  • No promotion of counterfeit goods
  • No promotion of illegal drugs or drug paraphernalia
  • No content enabling dishonest behavior (e.g., hacking, fake documents, etc.)
  • No content that facilitates copyright infringement

3.4 Mature Content

  • No pornography or sexually explicit content
  • No promotion of prostitution
  • No nudity (i.e., visible intimate body parts)

4.0 RESTRICTED CATEGORIES

These categories are not per se prohibited but do have particular requirements, as follows:

4.1 Alcoholic Beverages

  • Ads for alcoholic beverages must not mislead the audience into believing that the Ad is for a non-alcoholic beverage. This principle is particularly critical when the Ad is for an alcoholic lemonade, seltzer, or other beverages commonly considered to be non-alcholic in nature.
  • Advertisers cannot target individuals under the legal drinking age in the jurisdiction where the Ad is shown.

4.2 Gambling

  • Must comply with all applicable gambling laws
  • Cannot target minors, or those under the legal gambling age, in the applicable jurisdiction
  • Must display, or link to, information about how to resolve gambling addiction

4.3 Financial Products

  • Must comply with all applicable financial disclosure regulations, including those related to data privacy and data collection
  • Must disclose, or provide a link to, all fees and terms
  • Must provide legitimate contact information for the financial institution or service

4.4 Health and Pharmaceuticals

  • Must comply with all applicable healthcare regulations, including those related to data privacy and data collection
  • No health claims that are unsupported by independent and/or peer-reviewed, studies

5.0 POLITICAL ADVERTISING

5.1 General Requirements

    All political Ads must clearly identify themselves as political advertising

    All political Ads must include a "Paid for by" disclosure directly in the Ad
  3. 3.
    Must comply with all applicable election laws and campaign finance regulations
  4. 4.
    Must provide a link to information about who paid for the political Ad, including contact information

5.2 Notice Requirements

  • Include clear indication on the Ad itself that it is of a political nature
  • Provide detailed information about the political Ad sponsor when users engage with the Ad

5.3 Required Disclosures

  • Name of the entity paying for the Ad
  • Contact information for the Advertiser
  • Names of executives or officials responsible for the Ad
  • Links to relevant government databases of contributions, when required by applicable laws or regulations

5.4 Political Content Restrictions

  • No content that incites, threatens, or calls for violence, or uses obscene language
  • No content aimed at suppressing voters or delegitimizing elections
  • No content with unverifiable claims
  • No imagery of weapons being fired, or other violent images
  • No imagery of gratuitous human suffering

5.5 Recordkeeping

  • Advertiser must maintain its own records of political Ad spending and targeting
  • Advertiser should be prepared to provide this information if required by regulatory authorities
